'Shoot the Boer' song banned

March 26 2010 - Singing the ANC-hatespeech song"shoot the Boer" is now illegal, the South Gauteng High Court has ruled after an urgent interdict brought by a businessman. The South Gauteng High Court has ruled that use of the words is unconstitutional and unlawful, the report said.

The ruling follows an urgent interdict by Delmas businessman Willem Harmse preventing his colleague Mahomed Vawda from using banners with the words and singing the song during a march against the high rate of crime in Mpumalanga and Gauteng on April 9. Vawda unsuccessfully argued that the words figuratively meant "kill apartheid" and wanted them chanted at the march. Harmse argued the words “perpetuated hate speech and incited hatred”. The Court agreed with Harmse.

Mr Van As was a survivor from a previous hijacking when he also was shot and injured. The electrician’s property also was broken into about a week earlier when about R7,000 ‘s worth of electrical cabling was robbed.

“Dedda ‘s big son you must look after mama well. I love you,’  said the dying 49-year-old Jan Van As to his little boy while trying desperately to protect his family from the armed attackers.He told his life partner Elsie Smit, 37, pictured after the horrific attack, that he loved her. “Then I heard his last gurgling and he died,’ she told Ms Keppler.

The armed attackers had climbed through the burglar bars after bending them open and  arrived accosted the Afrikaner, demanding that he open his registered gun-safe.  Mr Van As apparently recognised of his his attackers --  shouting at them, said Ms Smit, as she heard him shouting: ; “Aren’t you the one who was on my property yesterday. Then two shots were fired…”

She heard that her life-partner then started fighting with the three gunmen while she and her little boy hid in the bedroom. “Another two shots were fired. Then it was quiet for a bit, and we heard another shot,’ she said. When the attackers fled, she and her little boy kneeled next to the dying Van As while he was bleeding to death next to the couch. He greeted them for the last time. Ms Smit then screamed for help through the window – and a neighbour and a police woman who just happened to drive past at  that moment, rushed in to help. “I pushed my fingers in the gunshot wounds trying to stop the bleeding. I screamed at him: ‘the first time you were hijacked and shot you survived it and you can do it again.’ she said. “It didn’t help.’ . "I am just grateful he didn’t rape me,’ said 79-year-old Afrikaner resident of Bloemfontein Mrs Hester Thomas after her attacker stabbed her above the eye, beat her purple and blue, choked her, jumped on her chest and kicked her during a so-called ‘house robbery’ in which very little of any value was actually ‘robbed’.  Volksblad journalist Vicüs Bürger reports that this is the third attack on elderly Afrikaners in Bloemfontein  within a week.   The widowed Mrs Thomas of Lilac Avenue in Gardenia Park, Bloemfontein contacted the animal welfare society to remove some feral cats from her garden. She’s lived alone for the past two years – and was waiting on her front stoep for the arrival of the animal-wardens when a ‘tall black man aged between 24 and 30 sauntered over and asked her for a job. She said she couldn’t help him; he sauntered away but returned a bit later demanding that she give him money – and then stabbed her wth a knife above her left eye – then cut off her belt and put it around her neck, choking her with it. “He beat me and dragged me around the outside of the house,’ she said. He also jumped on her chest. “He was very strong’. He opened the front door with the housekey she always has around her neck and dragged her inside. However the old lady tried to put up a defence, “I gave him all kinds of hell,’ she said: her toes are bruised because she kicked him; and she also grabbed ornaments, beating him with them. Her attacker tied her up and locked her up in the bathroom. It took her several hours to free herself from her bond – and she managed to unlock the bathroom door with a spare key hidden inside the room, she said. She rushed to her neighbours who alerted the SAPS. And while the attacker could have emptied the house of all valuables he apparently only stole some meat, cheese and some clothing – those items are missing. Her stepson Denis, a Bloemfontein businessman, said it was ‘unacceptable what happened to my stepmom. She ‘s a good woman.’ He also said that she was a strong-willed person who will be able to deal with the traumatic experience. Police captain Chaka Marope confirmed the ‘house robbery’. No-one was arrested. Two days earlier, the Van Vuuren family was attacked by a six-member gang with knives and spades. One of the victims, Mrs Francina van Vuuren (77) sustained brain-damage during the brutal assaults and is in coma in Pelonomi-Hospital. March 25 2010 – ALBERTON, Gauteng. "I had a house break-in  last week 10/3/10: the burglars broke my safe out the wall containing gun and jewelry. I’m convinced  it was an inside job as the SAPS visited me to do "gunsafe inspection" four weeks prior --  and were the only people who knew where and what was in the safe. I would like to take this further by reporting to higher authorities that they may possibly have some corrupt cops who are giving this info. to others. I have the names and I.D’s of the two that came and did the safe inspection. Have complained to the captain of the Alberton SAPS, but feel that nothing will happen. "Was told by another captain from another station that I should lodge a complaint with  Provincial H/O in JHB (near Parktown Boys High School).
